I have proven reluctant to weigh in with commentary on the avalanche of indictments against President Trump: I am not a lawyer, certainly not a Constitutional expert, I don't play either on the internet, and so many others already have commented to the point of nausea.
But, of course, weigh in, I will.
I have read the indictments, and, as I said, am not a lawyer. That said, the indictments don't pass the smell test, and seem clearly driven by an overwhelming political animus not only against Trump, but against any questioning of the "liberal orthodoxy." Even more troubling is the "burn the witch" caterwauling coming from so many in the media, precisely the industry which should serve as the most jealous guardian of the freedom of expression and political activity. The bottom line comes down to they don't like what Trump says, especially about them, so, put him in prison. They are aided by a "weaponized" FBI that from even BEFORE the first day of Trump's presidency conspired against him and his inner circle. Other federal agencies protect the Biden crime family and persecute any whistle-blower brave enough to sound the alarm.
This little post is a request for help from those who know the laws better than I. The Georgia indictments have me particularly outraged. They seem to be nothing burgers of the most empty kind, but then the punishment is the process, the process is the punishment. Just wondering does a County DA have the authority to indict a person who was President at the time he committed the alleged offenses? Shouldn't he have been impeached and convicted by Congress first? If not, this opens a whole can of worms for hundreds of DAs, all across the land, to start seeking indictments at a state, county, or city level. Chaos.

Reading law makes my eyes glaze over. Seems to be explained from what I read the Jan6 Impeachment has been handed to Jack Smith and Georgia DA Willis verbatim. It's a exercise to cost DJT funds, drain off any potential non informed voters and threaten anyone in backing him ( as the first 18 are finding themselves but I wouldn't doubt more to follow, especially if the Bolsheviks are successful in this Kangaroo Court.
ReplyDeleteThe left has figured out how use the slow process of the law to their advantage. They change election laws willy-nilly just before the election and there isn't time (nor oddly enough anybody with standing) to challenge those changes. Then, when the election is over it's all moot, so there is again no way to challenge what was done. Now they'll tie Trump (and any other conservative they set their sights on) with ridiculous indictments that will eventually get thrown out on appeal, but again it will all be a day late and a dollar short.

Doesn't look like the country is in for good times. Both sides consider each other criminals/traitors/vote-cheaters and both sides have large and committed bases of support. I don't see how this works out without a fight regardless of the underlying truth of the matters at hand.

ok.. I'll admit that I hadn't read the details. Georgia RICO law? Not about supposed activities committed in Georgia, but Georgia prosecuting Georgia laws against people who either never were in Georgia or are not accused of illegal or conspiratorial actions *in Georgia*?

I think there's a fair chance that SCOTUS will use this case to extirpate a large chunk of RICO law in general (ie, any laws that convict somebody of a crime that's not a crime in and of itself)

If in the run-up to a trial an indicted individual tries to blackmail a key witness, he would be charged -- if caught at it -- with witness tampering and obstruction of justice. If, however, the prosecutor pressures a key witness by threatening to charge that witness with additional crimes -- or by offering immunity -- why isn't that also witness tampering and obstruction of justice? Isn't the whole idea of a fair trial that prosecution and defense as far as possible operate under the same rules?
ReplyDeleteI'm guessing generally that's pretty tricky because a defendant tampering with a witness will generally be threatening some sort of illegal activity, where the DA will be threatening to invoke their prosecutorial discretion... which isn't illegal in itself (would be if they were receiving money, for example).
DeleteAlso theoretically, the DA can make those threats only to kinda get at the truth... and that's kind of specious because someone on the hook for breaking the law could be very creative about providing a 'truth'. So I think courts try to resolve this by making sure the jury knows the contingencies around a witness' testimony. "This guy would go to jail if he didn't testify... jury.. draw your own conclusions.." vs "This guy's kids will be murdered if he doesn't testify to exonerate the defendant"... the latter doesn't go over as well, I guess.
Much like the RICO crap.. it seems a little bit expansive... I'm not sure why these charges weren't leveled against the DNC when they were quite clearly defrauding primary voters in 2016. Well.. I know why... at the time, the US generally didn't engage in banana-republic-style sham kangaroo courts. I'm not sure what else could be expected in this atlanta crap. Basically the progressives have adopted a "If we can't prove they did something illegal, invoke RICO, so we don't have to actually prove anything, we can jail them just because everybody knows they're bad."

One of the most difficult things to deal with with the modern left is their immunity from punishment for their harmful and corrupt actions. Indeed, if caught out they can usually get a _better_ job than they had, lest any lefties become demoralized or fearful.
